Overview

Swift Currie’s environmental practice group focuses on all aspects of environmental civil litigation and administrative enforcement actions. We represent clients in matters ranging from water run-off suits to mass torts, toxic torts, EPA enforcement actions, RCRA claims, Clean Water Act claims, environmental site assessment claims and prosecuting and defending Superfund cost recovery actions.

Our team of environmental attorneys collectively draws from a broad spectrum of specialties to offer practical solutions to the environmental challenges our clients encounter. Thus, we can effectively resolve environmental issues arising from storm water run-off, while simultaneously defending a builder or contractor from traditional construction liability associated with proper implementation of BMPs. Likewise, our extensive experience in complex litigation dovetails with the complex multi-party litigation typically encountered in toxic torts and Superfund cost recovery actions.

Our environmental practice group also applies its expertise to evaluate and analyze complex coverage disputes arising out of environmental losses. We assist insurance companies in distinguishing between covered and non-covered elements of damage in environmental lawsuits and enforcement actions. We also litigate coverage issues, whether to disclaim coverage, seek indemnification from a responsible party, or pursue subrogation.
