In Georgia, insurers are often faced with a pre-suit time-limited demand that contains, in a judge’s words, “onerous, byzantine terms in the hope of causing a botched acceptance.” Georgia’s legislature has sought to remedy this game by amending O.C.G.A. § 9-11-67.1 in 2024. Recently, the Georgia Court of Appeals has issued multiple opinions interpreting the statute, upholding the protections the statute meant to provide. This webinar will guide attendees through the amended statute and how Georgia Appellate Courts interpret the statute. The attorneys will walk through the key elements of a proper acceptance and how to avoid unnecessary pitfalls. This session will equip carriers and adjusters with the tools they need to effectively navigate the rough waters of time-limited demands and their ever-changing legal landscape.
