"The Chain of Causation: How Far Does It Really Reach?”

Swift Currie attorney David Lindsey authored an article for the Daily Report discussing the chain of causation in terms of, when a new injury occurs after a previous on the job injury, whether it is compensable due to it naturally and directly resulting from the prior on the job injury. Lindsey emphasized that the Southeast largely views that employers take responsibility for these injury chains that result from an on-the-job injury.

“However, new and independent events can break the chain of causation,” said Lindsey. “When in doubt, obtain comprehensive medical information, document the circumstances carefully and conduct an investigation before making a final compensability determination.”
