Plaintiff claimed injuries from an unwitnessed fall at a store due to water on the floor. He went to the ER five days post fall claiming knee pain that led to an arthroscopic procedure. He presented medicals of over $30,000. He did not make a wage loss claim. The plaintiff had a history of pre and post-date of loss falls most of which he denied on deposition. The defense presented video evidence of a subsequent fall, argued it was staged and disproved plaintiff’s claim that he walked with a limp and used a cane every day post his fall. Verdict for the plaintiff below requested amount.
