Alabama Court of Civil Appeals Affirms Dismissal of Retaliatory Discharge Action
Amanda Goozée and Delaney Holmes successfully defended the dismissal of a retaliatory discharge action before the Alabama Court of Civil Appeals, securing an affirmance of the trial court's judgment in its entirety. The trial court dismissed the plaintiff's retaliatory discharge claim for failure to state a claim upon which relief could be granted. Goozee and Holmes argued that the allegations contained in the complaint foreclosed any reasonable inference that the termination was retaliatory, and the Court agreed, affirming the dismissal.
