Webinar
09.28.2023 | 1:00 pm – 2:00 pm EST

Attorneys Brandon Howard and Laura Gable will host the webinar "Walking the Legal Tightrope: Insurer Strategies for Effective Reservations of Rights Under Georgia Law" on September 28, 2023, from 1-2 p.m. Eastern.

In this webinar, attorneys will discuss an insurer’s duty to defend under Georgia law, options for responding to a tender of defense and the benefits and drawbacks of defending under a reservation of rights. The attorneys will provide practical guidance for drafting a clear and unambiguous reservation of rights letter in accordance with the requirements mandated by the Georgia Supreme Court. Additionally, they will discuss when an insurer should send a reservation of rights letter, the circumstances under which an insurer may amend or withdraw its coverage position letter and tips for avoiding waiver and estoppel of defenses to coverage. This webinar will also review the differences between unilateral and bilateral reservation of rights letters and how an insurer should respond to an insured’s objection to its coverage position or assignment of defense counsel. Finally, this webinar will explore how recent case law may affect an insurer’s strategies for reserving its rights under Georgia law.

The webinar will offer one general continuing education credit for attendees registered with the Georgia Department of Insurance (pending approval).
