When a claim is filed, the compensability of the employee’s injury is sometimes clear. However, when investigating whether the claimant’s injury falls within the scope of the Workers’ Compensation Act, employers and insurers must determine what defenses are available as a legal basis for denying a claim. Would a notice defense succeed when a claim is denied due to the employee’s failure to report their injury within a particular timeframe? What if an injury occurred due to the intentional or inadvertent removal of a safety device? What are the necessary steps to be taken to ensure a valid intoxication defense, or what if an employee was involved in an altercation with a 3rd party? During this webinar, Swift Currie attorneys will discuss these defenses, common scenarios that invoke them and their individual requirements. The attorneys will also review best practices and procedures for asserting these defenses.
