Top trends include: Medicare will be issuing Civil Monetary Penalties of up to $1,000 per day/per claim against noncompliant workers' compensation and general liability insurance plans/self-insured entities whom have failed to timely report claims and settlements with Medicare beneficiaries as early as April 2023 (once a Final Rule is finalized in February 2023); Medicare seeks to formally issue regulations around protecting Medicare's interest for future medical in liability, workers' compensation, and no-fault claims in 2023; and state Medicaid agencies are pursuing third-party liability subrogation against insurers.
