Georgia courts have made it clear that the duty to preserve relevant evidence can arise long before litigation is filed, and failure to do so can expose parties to severe sanctions. Understanding when and how that duty arises, and what steps to take to safeguard evidence, is essential for employers, insurers and defense counsel alike. In this webinar, the attorneys will guide attendees through the legal landscape of spoliation and sanctions in Georgia. Using recent case law and practical examples, they will explain how courts determine whether a party acted in bad faith, the levels of sanctions that may apply and how proactive preservation can protect your case before it begins.
