Typically, primary payers (workers compensation, general liability and no-fault insurance carriers/payers) with Medicare Secondary Payer Act (MSP) obligations have been most concerned about the federal government and/or traditional Medicare auditing their MSP compliance on claims. However, over recent years, it has been private actors/citizens that have sought to enforce the MSP more often than the federal government, making them more of a threat to the industry. Claims professionals should be aware of these lawsuits to avoid becoming a guinea pig for these private actors' litigation.
