Employment Retaliatory Discharge Under the Age Discrimination Employment Act (ADEA) Rebuffed

Long-term sales manager Harold Cohen asserted that he had been discharged on account of age, but his employer, the largest pool tile distributor in the country, asserted abundant non-discriminatory reasons for his discharge. He sought damages including back-pay of $436,500 and front pay of $636,691, plus liquidated damages for willful violation of ADEA and six-figure attorneys’ fees. After a two-week trial involving witnesses from around the country, a defense verdict was returned. An award of costs against the plaintiff was relinquished to resolve an appeal.
