David "Dave" C. Williams is a senior attorney in Swift Currie's general litigation practice group in Birmingham, Alabama. His practice focuses primarily on trucking litigation, general civil litigation, insurance coverage defense and premises liability. He has successfully litigated, mediated and arbitrated cases in federal court and throughout the state courts of Alabama. Mr. Williams serves his clients’ needs from pre-lawsuit consultation to discovery and through trial. He has several reported cases affirming summary judgments he received for his clients and been involved in a number of jury trial defense verdicts. Before joining the firm, he practiced for another Birmingham defense firm for nine years where his primary focus was general civil defense litigation and premises liability.

Mr. Williams attended Cumberland School of Law at Samford University, receiving his J.D. in 2005. After law school, he spent a year clerking for the Honorable Bruce E. Williams, Presiding Judge of Madison County, Alabama. He received his B.S. in health care administration from the University of Alabama in 2002 and was inducted into the Anderson Society, which is awarded to the top 25 seniors. He also served as a member of Capstone Men & Women, the official ambassadors for the university.

Mr. Williams is on the legal advisory subcommittee and a charter board member of Build UP, nation’s first and only workforce development model that provides low-income youth with career-ready skills through paid apprenticeships with industry-aligned secondary and early-postsecondary academic coursework, leading them to become educated, credentialed and empowered civic leaders, workers, homeowners and landlords.

Representative Reported Cases:

  • Tasha Robinson v Sovran Acquisition Limited Partnership et al., 70 So.3d 390 (Ala. Civ. App. 2011). Prevailed on a motion for summary judgment in a premises liability case in the Circuit Court of Jefferson County, Alabama concerning whether a storage facility was negligent, wanton, fraudulent and deceitful when unknown criminals broke into the storage facility and stole the plaintiff’s property while the storage facilities’ surveillance cameras were inoperable. Affirmed by the Alabama Civil Court of Appeals.
  • Ex parte Aaron’s Sales & Lease Ownership, Inc., et al., 170 So.3d 725 (Ala. 2013). Prevailed on a motion for summary judgment on claims for violation of the Federal Telephone Consumer Protection Act, 47 U.S.C. § 227, and invasion of privacy resulting from telephone calls to a customer’s cell phone by the first party creditor, Aaron’s. Certiorari denied by the Alabama Supreme Court.
